CEMEX Status of Events

On April 7, 2006, CEMEX, Inc. submitted a request for a discretionary Permit To Install (PTI) exemption from the Director of Ohio EPA (Director) to evaluate the use of whole tires as a supplemental fuel in the cement kiln at their Fairborn Plant. RAPCA and the Ohio EPA Division of Air Pollution Control are evaluating the request.

RAPCA requested additional information from CEMEX on April 24, 2006, and a response was received on September 1, 2006. RAPCA requested clarification of several items in the CEMEX response on September 29, 2006. The clarifications were received on November 2, 2006.

On December 11, 2006, the Director of Ohio EPA issued a discretionary PTI exemption to CEMEX that will allow the temporary use of whole tires as a supplement to the solid fuels consumed for cement (clinker) production. As a condition of the temporary PTI exemption, CEMEX must employ continuous emissions monitoring systems (CEMS) and conduct stack tests to evaluate air quality impacts. RAPCA is currently awaiting notification from Cemex regarding the emissions testing protocol.

On October 15, 2007, CEMEX notified RAPCA that they would not be able to fulfill all of the requirements contained in the PTI exemption by the December 11, 2007 expiration date and requested a "follow on" to fulfill the requirements that were not met. The Director has decided not to allow CEMEX to extend the temporary exemption.

May 16, 2008 - After reconsideration as part of an appeal filed by CEMEX with the Environmental Review Appeals Commission, the Director issued a new temporary PTI exemption that will allow CEMEX to finish installation of the necessary equipment and complete air emissions testing to evaluate the air emissions associated with the use of whole tires as a fuel supplement for the cement kiln at the CEMEX Fairborn Plant.

August 28, 2008 - RAPCA representatives presented information to the Yellow Springs Environmental Commission and the public regarding the PTI exemption issued to CEMEX for purposes of evaluating the air emissions associated with the use of whole tires as a fuel supplement for the cement kiln at the CEMEX Fairborn Plant. - View Presentation
